[Trademark] Opposition Period Shortened to 30 Days Beginning July 22, 2025

Up until June 30, 2007, the trademark opposition period was 30 days. However, due to concerns that this period was too short, it was extended to two months from July 1, 2007.
Given the often ‘transient’ nature of trademarks, there has been renewed criticism recently concerning the lengthy period of time required to register a trademark in Korea, despite the pressing need for rapid protection of trademark rights. In response, a legal revision has been enacted to shorten the opposition period returning it to the previous 30-day term.

For trademarks published before the enforcement date of the revised law, July 22, 2025, the opposition period will remain as two months. For instance, trademarks published on July 21, 2025, will have an opposition period ending on September 21, 2025, while those published on July 22, 2025, will have an opposition period ending on August 21, 2025.

Since extensions to the opposition period are not permitted, adhering to the deadlines is critical. If you intend to file an opposition but lack sufficient time to prepare, the advice is to submit at least a simple notice of opposition within the deadline. The official deadline for supplementing reasons and evidence is 30 days from the expiration of the opposition period. However, in practice, reasons and evidence can be supplemented in the form of a written opinion before the opposition decision is issued.
