DID YOU KNOW?: Korea offers the possibility of requesting an interview with the Examiner to discuss ideas and review amendments of a Patent Application Office Action. An interview with the Examiner is a useful means to better understand rejection grounds and to respond appropriately during the examination proceedings of a Patent Application. For simple rejection grounds, an informal phone conversation may be sufficient. However, where a specific issue could not be clearly resolved, or if requested by the Examiner, a request for a further formal interview or meeting for a Preliminary Review of Amendment may be made. This allows for an in-depth exchange of opinions regarding preliminary proposed amendments before filing a Final Amendment, and can be requested by filing arguments including the preliminary amendments, by 1 month before the lapse of the deadline for a response to an outstanding Office Action. Since the Examiner is obliged to file a brief report after such a formal interview or meeting as part of the proceedings of a Preliminary Review, Examiners tend to more actively contribute to such an interview compared to a simple unrecorded telephone conversation. If a patent application is finally rejected despite a response to the Office Action, a Request for Re-examination can be filed. In this case also, a request can be made for a Re-examination Review by 30 days before the deadline for a Request for Re-examination. During this review, opinions can be exchanged with the Examiner regarding preliminary amendments; thus, improving the overall success rate of a re-examination. However, please note that a re-examination review cannot be requested for a Patent Application for which a Preliminary Review of Amendment has already been conducted. |
